The Short Answer
In Texas, there's no single law that says "you must report to your insurance within X days." But your insurance policy almost certainly has a requirement — and it's usually as soon as possible or within 24–72 hours.
That means the safest move is simple: call your insurance agent the same day.
Why You Shouldn't Wait
Even if the accident seems minor, waiting to report it can cause real problems:
- The other driver could change their story. Once their insurance hears their version first, it's harder to set the record straight.
- Evidence disappears. Photos, witness contact info, and skid marks don't last.
- Your policy may deny the claim. Many policies say late reporting is grounds for denial — even if the accident wasn't your fault.
- Injuries can show up later. What feels like "just soreness" today can be a real injury a week from now. If you didn't report the accident, it's much harder to connect it.
When Texas Law Does Require a Report
You must file a CR-2 crash report with the Texas Department of Transportation within 10 days if:
- Anyone was injured or killed, or
- The damage appears to be $1,000 or more to any one person's property.
But again — that's the legal deadline. Your insurance deadline is almost always much sooner.
The Steps to Take Right Now
1. Make sure everyone is safe
Call 911 if anyone is hurt. Move to a safe spot if you can.
2. Call the police
In Texas, an officer's report makes everything easier — especially if the other driver is at fault.
3. Take photos
Get pictures of both cars, the road, any damage, and the other driver's license plate and insurance card.
4. Get witness info
Names and phone numbers. They can make or break a disputed claim.
5. Call your insurance agent

What If the Other Driver Was at Fault?
You still report to your own insurance first. Your company will then go after the other driver's insurance to recover the money. This is faster and less stressful than fighting the other company yourself.
If the other driver has no insurance, your uninsured motorist coverage (if you have it) can step in. Not sure if you do? Call us and we'll check.
The Bottom Line
After an accident, same-day reporting is always the safest choice. It protects your claim, your evidence, and your peace of mind.
